Why was the Council overruled on housing development in Hawkwell?

Both John and Christine Mason were present and gave evidence to the Appeal Hearing and will now take a closer look at how the Inspector made his decision.

The Inspector explains why the preferred strategy of Hawkwell Parish Council could not have been included in the Core Strategy because it would not have complied with new Government Policy.

The new Government National Planning Framework (NPPF), which only came in late last year, certainly featured in the Inspector’s decision made in favour of the developer but there would also appear to have been lapses in the planning policies of Rochford District Council where Councillor Hudson is the Cabinet Member for Planning and Transportation.

 The story in the Echo dated 6 May 2012 by Emma Thomas entitled “Developer ramps up plan for homes on green belt in Rochford” sums up the present situation quite well and being in the public domain enables us to comply fully with the Code of Conduct  which determines what we can say legally as your Ward Members.

You might have missed the article because it was filed under Southend and Hawkwell was missed from the headline.  So we are going to repeat most of it here so that you can be informed.

Could there be a Reduction in House Building Targets in Rochford District

Yes, there could be, but many residents who listened to and read the promises made about over development of the green belt at the General and Local Election in 2010 think that the new Government has stopped all building on green belt.

No that is not the case, far, far from it.

Well the RSS Housing targets have been revoked. What does that mean then?

It could mean this;

Rochford Core Strategy Housing Location Hearings

With all the recent talk and focus on the The Pickles Letter it has been easy to forget that the Public Examinaton of the Rochford Core Strategy is still continuing under the direction of Government Planning Inspector, Miss Laura Graham.  Indeed the Hearing on Housing that was attended by many residents and residents groups was only on 12 May 2010.

During the Hearings many questions were asked and challenges made of the Council.

Miss Graham asked the Council to provide the following additional information by 11 June.

What local councils could do to stop an existing or emerging Core Strategy

Rochford District Council says in its Press Release that it has to continue to proceed with its Core Strategy (CS) because although the Secretary of State, Eric Pickles, has announced the new Government’s intention to abolish the Regional Housing Targets (RSS) it has not passed legislation.

It has been said by other planners that Section 79 of the Local Democracy, Economic Development and Construction Act 2009 sets out the Secretary of State’s reserve power to revoke a regional strategy where the Secretary of State thinks it, necessary or, expedient to do so.

The Rochford Lib Dem web site “OnlineFOCUS” has published an interesting article here .

Summary of the Article:

Recent changes have been made by the Coalition Government to Planning Policy PPS3 where the previous requirement  that new housing was supposed to be built at a minimum density of 30 units per hectare has now been dropped. Gardens are no longer classified as ‘brownfield’ sites and that will reduce any incentive for councils to rely on garden land for development sites. Our local planners at Rochford District Council have been asked  by how much the rules have changed. The answer is : not very much, so far.

Government Planning Inspector says that Pickles’ Letter is Material

PUBLIC scrutiny of Castle Point’s housing proposals has been postponed following the Government’s announcement it will return planning powers to local communities.

The change comes after Eric Pickles, Secretary of State for Communities and Local Government, confirmed the Government planned to scrap Labour’s housing targets.

Government inspector Paul Crysell, who will be carrying out the examination, said: “Because the Government intends to abolish  regional  spatial strategies, this becomes a material consideration in examining development plans.”

“For this reason, it is necessary to defer, at the very least, the hearing session on housing into the Castle Point core strategy until clarity is provided in a formal ministerial statement.”

The Pickles Effect – Forest Heath throws out planning application in Newmarket

BBC Look East carried a story tonight with presenters in Suffolk and in London stating that this was the first planning test of the Coalition Agreement ‘s declaration that the RSS housing targets would be abolished and the controversial letter that was issued by Eric Pickles on 27 May to all council chief planners in the UK.

ABOLITION OF REGIONAL STRATEGIES

I am writing to you today to highlight our commitment in the coalition agreements where we very clearly set out our intention to rapidly abolish Regional Strategies and return decision making powers on housing and planning to local councils. Consequently, decisions on housing supply (including the provision of travellers sites) will rest with Local Planning Authorities without the framework of regional numbers and plans.

The New Liberal/Conservative Coalition Government has made some big announcements on planning today and we have taken this direct from the full document below.

But does this really mean;

  • the end of the Core Strategy?
  • the certainty of dismissal of the Hawkwell and Coombes Farm Appeals?
  • that RDC can turn down the queue of big planning applications simply on prematurity?
  • Or will some or all of these things skid through because the Law will not be changed quickly enough?

Hawkwell Planning Application Refused

The Rochford Independent congratulates the individual residents who made written representations to Rochford District Council and to the organisations which ran campaigns of objection, namely The Hawkwell Action Group (HAG) and The Hawkwell Residents Association.

The David Wilson Homes Planning Application was Refused Permission last night, 3 December 2009, by the unanimous recorded vote of District Councillors present at the Development Control Committee.

One of the Ward Councillors, John Mason, led the debate having heard a presentation by Officers, and speeches by Mr. Hull on behalf of the Applicant, Parish Councillor Myra Weir on behalf of Hawkwell Parish Council and John Dagg QC on behalf of The Hawkwell Residents Association.

330 reasons to object to new houses in Hawkwell

160 residents from Hockley and Hawkwell went to the Rochford District Council Meeting held at the Hawkwell Village Hall to protest against the proposal from the Council to build 330 new houses between Thorpe Road and Clements Hall Way.

Independent District Councillor John Mason for Hawkwell West spoke at the end of the Meeting at the request of a resident to explain whether he was against the proposal.

The Hawkwell Action Group (HAG)

A group of residents in Hawkwell West have formed a organisation called the Hawkwell Action Group (HAG) which has the purpose of ensuring that all of the residents of my Ward are independently advised of proposals affecting Hawkwell West in the Local Development Framework (Planning for Housing) and that as many residents as possible respond to the public consultation.  I was invited to join the HAG Committee and I have done so.

As a District Councillor for Hawkwell West I have a duty to represent my Ward as well as the District.  I am not doing this to preserve my re-election chances. I promised residents that I would protect green belt and I will do my best.

No more homes for Hawkwell

I am campaigning against the housing allocation for Hawkwell.

If an additional 365 homes were to be built in the village the road infrastructure in would have to be improved to cope.

In addition there are many more homes to be built in Rochford district where car movements could cause those people to travel through Hawkwell.

I am writing further to our conversation this morning concerning the RDC public consultation on the LDF Core Strategy which took place in May and June of this year. 

As a District Councillor I informed residents by Newsletter that the RDC allocation to Hawkwell and Hockley was 400.  The District Council also released details of those landowners who had put their land forward for consideration of allocation for development.  You can find maps and descriptions on the RDC web site at http://www.rochford.gov.uk/rdc/main.asp?page=1101

Is this the big debate that is needed in Rochford District?

Do you know someone who is finding it difficult to rent or buy their own home in Rochford District, or know someone who has had to move from the District to find a home? Most likely, Yes. But what is Rochford District Council going to do?  It has been reminded that it must look at the following data so by the IDeA Review Team this week.

A Housing Needs Survey was completed in 2004 and it identified that 67% cannot afford private rental and home ownership is beyond the reach of 75% of concealed households, even though nearly 40% of them earn over £25,000 p.a.The Survey established an outstanding net total need for 291 affordable homes per annum. This calculation took into account the Council’s waiting list, homeless and concealed households, and requirements emanating from demographic changes. It is clear from the study that there is too little affordable housing in the district to satisfy local needs. Over 15 years that means 4,500 affordable homes. The current Government target for Rochford District for the same period is an additional 3700 houses. But the Rochford District Council is only proposing 30% of that figure based on each new development over 25 houses contributing 30%. There will be an affordable homes deficit of around 3,300 homes.

The two public consultations on the “Housing Target” (LDF) have shown that the public is overwhelmingly against further loss of Green Belt. But did they realise that 67% of the population of Rochford District cannot afford private rental and home ownership. Most likely, No. (Here are the latest consultation results.)

But it is clear from anouncements this week from Gordon Brown and David Cameron that this issue must be faced up to by Rochford District Council.

Gordon Brown has put affordable housing at the top of his Government’s agenda by announcing plans to build three million new homes by 2020. He told MPs that the number of new homes to be provided each year would be raised by 40,000 to 240,000 a year. He promised to “protect robustly” the green belt but left the door open to some limited building in it, saying that “principally brownfield land” would be used for the new programme. But there appears to be little brownfield available in Rochford District.

David Cameron has warned his party it may need to drop its opposition to new housing so don’t expect the Conservatives at Rochford to be able to protect Green Belt.
